ESADE Alumni is pleased to invite you to this continuing education session entitled Reglamento General de Protección de Datos: un primer balance de su aplicación (“The EU General Data Protection Regulation (GDPR): A Preliminary Evaluation of its Application”) by Antonio Delgado (Lic&MD 00 / DTI 02), an Assistant Professor in the ESADE Department of Law specialising in Mercantile Law and director of the Master in International Business Law offered by ESADE Law School, and Xavier Ribas, Partner at Ribas y Asociados and Co-Director of the Master in ICT Systems, Social Media and Intellectual Property Law offered by ESADE Law School.

The aim of this session is to analyse the EU Regulation’s initial progress. Specifically, the session will examine the security breaches informed about thus far, the key errors committed by some companies and some firms’ best practices, amongst other issues.

 

 

Antonio Delgado

Antonio Delgado (Lic&MD 00 / DTI 02) began working as an attorney in the telecommunications industry when the latter was liberalised. He took on numerous responsibilities within the AUNA Group and later in ONO where he was named Regional Director for Catalonia and Aragon. In 2007, he joined the Electronic Banking and New Technologies Area in 'la Caixa' bank as an area specialist. In 2009, he became the Director of Legal Services for Hospital Clínic de Barcelona, becoming especially involved in providing legal advice on innovation development and, in particular, on research transferal.

Antonio began collaborating with ESADE in 2000 upon completing his first degree, teaching classes in Mercantile Law. Since then, he has taught classes in the Law and Business Schools as well as in the MBA programme and other specialised classes dedicated to the cultural and creative industries. He successfully combined both legal practice and teaching until 2012 when he joined ESADE full time.

In his PhD thesis, he analysed legal transactions between creators and companies in the cultural and creative industry, particularly, in digital settings. Antonio believes that efficiently regulating intangible assets is necessary (whether in terms of intellectual or industrial property rights), promoting economic equilibrium between new business models and society’s access to those goods. This is the focus of his research.

 

Xavier Ribas

He is the founding partner of Ribas y Asociados and has dedicated himself professionally to Information Technology Law since 1987, becoming an expert in compliance. In this vein, he has directed several dedicated programmes such as the Compliance Officer Course and the DPO-GRPD Course for Thomson Reuters Aranzadi as well as the Compliance Internship for the latter. In addition, he has been a professor of Technological Compliance at ESADE and has served as Director of the ESADE Master in ICT, Social Media and Intellectual Property Law (IT+IP).

He has received numerous professional distinctions. In 2013 he was named one of the top 25 attorneys of reference in Spain by the Expansión financial daily. In 2013 and 2015, Best Lawyers named him the best attorney in the data protection area and the attorney of the year for IT Law in 2014. In 2012 he received the best attorney award in Digital Law at the ICAB-Digital Law World Congress. Similarly, Chambers and Best Lawyers named him one of the best attorneys in privacy and data protection, information technology, intellectual property, media and communications.

He was a partner at PwC (1998-2012), in charge of the company’s ICT Law international network (2000-2004). He also served as a CISA (ISACA) computer auditor and achieved the Certification in Risk and Information Systems Control (CRISC) from ISACA. In addition, he was the First Vice President at ENATIC (2012-2015). Previously, he was a Member of the AUI Management Board (1996-2003) and Legal Adviser for the Business Software Alliance (BSA), from 1988-2011.
 
In addition, he is a member of the Spanish Electronic Trade Association’s (Asociación Española de Comercio Electrónico) Regulation Commission. He served as President of the Spanish Association of Technological Arbitration (ARBITEC) from 1989-2015. He is a member of the Legal Working Group for UNECE-CEFACT (United Nations) in the e-commerce area, a member of ISACA (Information Services Audit and Control Association) and a member of the Illustrious College of Attorneys of Barcelona (number 12,698).

He has authored the book, Aspectos juridicos del comercio electronico en internet (Editorial Aranzadi, 1999), on the legal issues related to e-commerce, and the manual, Manual Práctico de Contratación Informática CONTRACT-SOFT (1987-2003, 11th edition). In addition he has authored the LOPD – RMS – LSSI – Technological Contracts and Intangible Assets control panels. Lastly, he has participated in the NATO Allied Command’s LATHE GAMBIT project, dedicated to analysing the legal setting and internet security as regards cybercrime.
