ESADE Alumni invites you to a talk in the Law Refresher Programme entitled, ''European competition regulations in a global market'', by Javier Fontcuberta (EDP 06), Associate Professor in ESADE’s Department of Private Law.

Fair competition has become a matter of extraordinary importance in modern business law. Mergers and acquisitions are sometimes affected by the assessment criterion of the regulatory bodies, which may frustrate or irrevocably alter them.

In addition, bans on certain behaviour such as price cartels and the risk of significant penalties for offenders may also affect agreements between companies. Bearing in mind leniency schemes making it possible to avoid paying fines and the tendency amongst states and supra-states to apply such regulations beyond their borders, it may be surmised that fair competition is an issue of global importance which requires in-depth, critical analysis.

 

 

 

Javier Fontcuberta

Javier Fontcuberta (EDP 06). Associate professor, Department of Private Law, ESADE. Fontcuberta holds a PhD in Law from URL, Degree in Law from UB, Executive Development Program from ESADE, Research Proficiency Certificate from UB, P.I.L. from Harvard Law School, Cambridge, Massachusetts, USA, Master in Corporate Legal Advice from IE, and graduated as an accountant from the Escuela de Administración de Empresas de Barcelona. He is a partner at Cuatrecasas Gonçalves Pereira, and board secretary and legal advisor in several companies. He was also the board secretary in La Seda de Barcelona, S.A. from 2009 to 2012. Besides holding these posts in other LSB Group companies, he has also held, or still holds, some of these responsibilities in companies including Audi Tooling Barcelona, S.L., Gearbox del Prat, S.A., Audi Real Estate, S.L., Volkswagen Group Retail Spain, S.L., and Centro Técnico de SEAT, S.A. A regular speaker on subjects related to company law in Spain and abroad. Author of the book 'El contrato de distribución de bienes de consumo y la llamada indemnización por clientela' (Ed. Tirant lo Blanch, 2009) and the chapter ''Derecho de Empresa'' of the 'El MBA de ESADE' (Ed. Planeta,  2010). He has also penned several academic papers and often writes articles for the press.
